Lawyers are expensive (VERY!) Court dockets are clogged (just getting TO court can take months to years, and with various motions, and then appeals , a trial can take months to YEARS).

And once you DO get there, your issues become a public show. You have no privacy as you talk about what happened, and maybe get viciously cross-examined by “the other side” and made to look like it’s all YOUR fault!

Mediation is THOUSANDS of dollars less expensive, and takes MUCH less time (sometimes just a day, or even just PART of one). The conflict, issue, AND the parties get dealt with respectfully in an effort to understand what happened and why it arose on BOTH sides, the emphasis being placed on finding a solution that works for both (or all) parties, WITHOUT time wasted with each side and their lawyer emotionally browbeating and accusing the other of being “the bad guy”. It’s done in private with JUST the people involved with the dispute and the Mediator(s) present. The whole process is designed to find a solution that resolves the issue(s) ONCE… and “for all”… through the trained assistance of a neutral “third party” with no “axe to grind”, and the agreements reached through Mediation are upheld BY the Courts just as if they were ordered BY them.

“CERTIFIED” Mediators are highly-trained professionals (and may BE lawyers), regulated by State Statute. Mediation is REQUIRED of most cases in the District and Superior Courts prior to trial (or at least to be mentioned by lawyers to their clients as an option to going ahead with trial), but the truth of the matter is that most attorneys ignore that requirement, preferring to fight issues out in Court as they’re trained to do, know HOW to do (and get paid so handsomely to do).

Litigators (lawyers who try cases in court) are trained to present their clients’ “side” on an issue, and to FIGHT – and ONLY for that, leaving it to the lawyer for the other side to fight equally hard for his/her client’s side, leaving it to a jury (or a judge) to “decide” what happened based on what they’ve heard in testimony and seen in evidence, and believe… as a result that duel between the lawyers, and to a judge to decide what law should apply, and how it should apply to the jury’s decision of “fact”.

Mediators are trained to help people resolve conflicts between themselves. Quickly. With understanding of the human foibles we ALL have and suffer from… and of the “issues” that arise because of them… and to help to bring the conflict to an end through mutual agreement as pleasantly as possible by TALKING. And “reasoning” with both sides. Not by fighting.
